Preamble
To use the https://nutritioapp.com platform, hereinafter “Platform”, it is recommended that you read and accept the terms and conditions below, “Terms and Conditions”, which have the value of a contract concluded between NATURALPIXEL SRL and any person, customer, or user accessing the platform. Further use of the platform implies the full and unconditional acceptance of these Terms and Conditions. If you do not agree to the Terms and Conditions, please contact us at contact@nutritioapp.com.
Terms and Conditions apply to all sales of products and services provided by NATURALPIXEL S.R.L. through the Nutritio platform.
Terms and Conditions may be changed at any time by NATURALPIXEL. Such changes will be considered as accepted by simply using the platform, and will only produce legal effects for future contracts, not for contracts already concluded.
Definitions
Free content is publicly accessible content without the need to create an account on the platform.
Paid content is the content accessible by users who created an account on the platform and paid their monthly subscription.
Bonus is the digital services that NATURALPIXEL can offer to the Customer free of charge for a specified period of time when purchasing the Content for a fee.
Customer is any person who has accepted the Terms and Conditions that uses the platform, including accessing, navigating, or creating an account on the platform, and who has launched an Order through the platform, and the Order has been confirmed by NATURALPIXEL;
The order is a form of electronic communication between Client and NATURALPIXEL, through which the Customer requests delivery of the selected Content, and agrees to receive and pay it under the terms and conditions set forth in these Terms and Conditions;
The account is the platform section that can be accessed by the Client by entering an email address and a password; The account allows the Customer to submit the Order and contains information about it and its history on the Site, invoices issued, etc.
The Agreement represents these Terms and Conditions together with the Order, confirmed by NATURALPIXEL by e-mail;
Content means those digital products and / or services that may, as the case may be, be any sound and / or video recording and / or text in any format and / or interactive multimedia and / or photo presented within the platform, and / or consulting hours, and to which access is made, as appropriate, free of charge or against payment;
User is any person who has accepted the Terms and Conditions by using the Site, including accessing, navigating, or creating an account on the platform.
Agreement on Electronic Communication
By accepting these Terms and Conditions, you consent to the fact that any communication in connection with the conclusion, execution or termination of the Agreement will be communicated electronically.
Command Launch and Confirmation
By completing and finalizing a Content Purchase Order, the Customer accepts the NATURALPIXEL Content Offer. The moment of closing of the Contract is when NATURALPIXEL sends to the Client a confirmation of accepting the Order via email in the form of a welcome message in the platform, without the need for any other confirmation of receipt from the Client. An Order not Confirmed by NATURALPIXEL as above does not have the value of a Contract between NATURALPIXEL and the Client.
Intellectual property law
NATURALPIXEL is the exclusive owner of Intellectual Property Rights on the Platform, Software, and Content, graphics, logos and images uploaded to the Site. The rights granted to you are only non-exclusive and non-transferable usage rights. The non-exercise or delayed exercise by NATURALPIXEL of its rights deriving from the Contract shall not be considered a waiver, as the sole or partial exercise of any right shall not prevent the continued exercise of any other right.
Content is the exclusive property of NATURALPIXEL, and its use by the Client is subject to these Terms and Conditions. The Customer undertakes to respect the intellectual property rights of NATURALPIXEL on the Content. Except for the rights granted under paragraph below, Customer is not permitted to copy, distribute, publish, transmit, transfer, sell, disseminate, rent, borrow, modify, adapt, edit or sub-license the Content. Customer is not granted any rights of use for the purpose of advertising the Content.
NATURALPIXEL grants the Customer, in return for payment of the Price by the latter, a non-exclusive and non-transferable use right on the Client’s selected Content. The right of use is for the Customer’s personal use only, excluding any commercial use.
Price. Billing
The price corresponding to the purchased content is that specified on the Site and highlighted in the Order completed by the Client and confirmed by NATURALPIXEL.
The price of the Content is paid in EUR, USD or RON before its use. NATURALPIXEL reserves the right to cancel any Order when the price of the Content was erroneously displayed on the Site, including a technical error.
NATURALPIXEL will issue to the Customer an Invoice for the Order, based on Customer’s billing data that he has made available to NATURALPIXEL in advance.
Payment Methods
The ways to pay for the Content are as follows:
Credit Card Payment: In the case of payment by Credit Card, the Customer introduces the identification data of the card with which to make the payment, from the Customer’s card account, the amount required for payment of the Content will be debited.
If NATURALPIXEL does not receive confirmation of the bank account bank account within 7 days from the date of the Order, the Order is canceled and the Account created by the Client is deleted. In the event that, for whatever reason, the bank transfer account is still available after the expiration of the 7-day period, the Customer has the possibility to refer NATURALPIXEL by filling in the complaint form and requesting the refund of the amount paid, in which case NATURALPIXEL will refund it to the same bank account from which the payment was made, within 15 days of the date of the request. If Customer requests Reactivation of the Order, it will only be able to return the Order through the Site by selecting the same bank transfer payment method after accepting NATURAL PIXEL. If the Content for which the Order has been released is no longer available on the Site, NATURALPIXEL will return the amount paid by the Client to the bank account from which the payment was made.
Right of withdrawal
According to the legal provisions, the provision of digital content that is not delivered on a physical medium is exempted from the right to withdraw from the contract, if the performance has begun with the express prior consent of the Customer and after he has confirmed that he has knowledge of the fact that he will lose his right of withdrawal as well as the service contracts after the full performance of the services if the execution has begun with the express prior consent of the Customer and after he has confirmed that he has knowledge that he will lose his right upon withdrawal after the full execution of the contract by NATURALPIXEL.
In consideration of the foregoing, Customer understands and agrees that the subject of this contract involves the provision by NATURALPIXEL of digital content that is not supplied on a material basis, giving its express prior consent to the provision of digital content and confirming that it has learned of losing his right to withdraw provided by law. The customer also confirms that he has learned that he will lose his right to withdraw after the full execution of the contract by NATURALPIXEL and, by this means, expressly and expressly gives his consent to the start of performance of the contract.

NATURALPIXEL does not provide services, remedies, treatments and / or medical analysis, but provides recommendations for improving the lifestyle of the person. NATURALPIXEL draws attention to the fact that any medical condition should be investigated and treated under the supervision of a qualified medical practitioner. NATURALPIXEL recommends nutrition advice with a healthy lifestyle specialty that can lead to a normal weight for people, but they are not a guarantee of this result and do not substitute for medical services. NATURALPIXEL is just an intermediary between the Client and the Nutritionist, all the responsibility for the diet followed by the customer being supported by the Specialist who offers consultancy through the platform.
Major Force
Neither party shall be liable for non-performance of its contractual obligations if such non-execution is due to a force majeure event. By force majeure is meant any external, unpredictable, absolutely invincible and inevitable event that occurred after the entry into force of the contract and which impedes the partial or full execution of the obligations assumed by the parties.
Account
In order to access and use certain sections of the Site, it is necessary to create a personal account (the “Account”). By using the Site, the Client assumes full responsibility for all activities made through the Account he / she opens to the Site. As a consequence, the Customer is solely responsible for ensuring the security of the Account password and other access data.
If the Security of the Account is compromised, it is necessary to immediately notify NATURALPIXEL as the Site Administrator. NATURALPIXEL can not be held responsible for damages caused to Customers / any third parties through unauthorized use of the Account.
Complaint resolution procedure
For complaints or complaints about the Content purchased from the platform, please contact us at contact@nutritioapp.com. NATURALPIXEL will resolve any referral or complaint within 30 calendar days of receipt.
By opening the Site Account and / or transmitting the Order, the Customer expressly agrees that NATURALPIXEL will transmit commercial communications about the Content offered by NATURALPIXEL. If the Customer does not wish to receive such communications, he may unsubscribe by accessing the link to this destination from the e-mail received.
NATURALPIXEL does not collect any personal data other than those provided by the Client. If the Customer does not want NATURALPIXEL to collect his or her personal data, the Customer does not have to provide this data. Customer may request NATURALPIXEL, by written, dated and signed request, to delete processed personal data; the deletion of personal data will be accompanied by deletion of the Site Account.
Divestiture and subcontracting of NATURALPIXEL obligations
NATURALPIXEL may assign and / or subcontract to third parties, wholly or in part, this Agreement, informing the Customer, without its consent. NATURALPIXEL will be responsible to the Client for the proper performance of all the obligations assumed under the Contract.
Applicable law. Jurisdiction
The contract is concluded in Romanian and is governed by and will be interpreted in accordance with the Romanian law. The parties agree that all disagreements regarding the contract or the interpretation, execution or termination of the contract shall be settled amicably. If settlement is not possible in an amicable way, disputes will be settled by the competent court of law.
Delivery policy
The digitized products (access to the platform) will be delivered within 24 hours of the payment on working days, most often the delivery is instantaneous.
Refund policy
If the Clone wishes to return the money, it will be done within 30 days, based on a request sent to contact@nutritioapp.com within 15 days of payment of the digital services / products.
Data protection
According to the requirements of Law no. 677/2001 on the Protection of Individuals with regard to the Processing of Personal Data and Free Movement of such Data, as amended and supplemented and of Law no. 506/2004 on the processing of personal data and the protection of privacy in the electronic communications sector NATURALPIXEL SRL has the obligation to administer safely and only for the specified purposes, the personal data you provide us about you, a member of your family or another person.
The purposes of data collection are: health services, statistics, scientific research, advertising, marketing and advertising.
You are required to provide the data, which is required when signing up for the Nutritio platform. Your refusal determines our inability to provide access to the Nutritio platform.
The recorded information is intended for use by the operator and is only communicated to the following recipients: the nutritionist / doctor supervising nutrition programs if you are a beneficiary of a nutritional program; to any other party if you are a nutritionist / physician / nutritional service provider.
According to Law no. 677/2001, you have the right to access, to interfere with the data, the right not to be subject to an individual decision and the right to appeal to the court. At the same time, you have the right to oppose the processing of your personal data and to request the deletion of the data. To exercise these rights, you may address us with a written request dated and signed at contact@nutritioapp.com. You are also granted the right to appeal to the courts.
